As part of our service, we agree to provide you with information and other services that we may decide to offer, subject to the terms of this agreement. Upon notice published through the service, we may modify this agreement at any time. You agree and continue to agree to use our services in a manner consistent with all applicable laws and regulations and in accordance with the terms and conditions set out in the policies and guidelines outlined below. Please note that you will be referred to as 'customer' in this agreement.

General

We may from time to time change the rules that govern your use of the Site. Your use of the Site following any such change constitutes your agreement to follow and be bound by the rules as changed. We may change, move or delete portions of, or may add to, the Site from time to time including, but not limited to, content and equipment and/or software needed for access or use.

Rules For Online Conduct

By using the service, you agree that you will not attempt to undermine the integrity of this web site.

Acceptance Of Orders

Once you have submitted an order, we reserve the right to not accept and/or cancel any order we feel is not appropriate to fulfil, for what ever reason. We will notify you where possible and refund the order within 28 days.

We only allow orders to be placed via our website and not through any third party, over the telephone or by mail.

Copyrights, Trademarks And Other Intellectual Property Rights

Unless otherwise noted, all materials, including images, illustrations, designs, icons, photographs, and written and other materials that are part of the Site are copyrights, trademarks, trade dress and/or other intellectual properties owned, controlled or licensed by blazingclothing.co.uk. The Site as a whole is protected by copyright and trade dress, all worldwide rights, titles and interests in and to which are owned by blazingclothing.co.uk.

You warrant that, in obtaining the Material and submitting it to blazingclothing.co.uk for reproduction, you have not violated or infringed on any trademarks, copyrights or other intellectual property rights of any third party. You agree to indemnify and hold blazingclothing.co.uk, and its directors, officers, employees and agents (“blazingclothing.co.uk Parties”) harmless from and against any suit, demand, claim, loss, liability, damage or expense made against or incurred by blazingclothing.co.uk Parties by reason of breach of this warranty, and you agree to pay any judgment or settlement offer resulting from any suit, demand, or claim, and to pay any attorney's fees incurred by blazingclothing.co.uk Parties in defending against any such suit, demand or claim.

The burden of determining that any Material is not protected by trademark, service mark, copyright or other proprietary right rests with you. You are solely responsible for obtaining proper permissions and licenses, except as may be permitted by copyright law, from third parties whose rights may be violated or infringed by the use of any Material protected by trademark, service mark, copyright or other proprietary right. To use any logo, trademark or copyrighted items, a customer must have written permission from the owner of the logo or trademark or copyright. A customer may not use any logo or other graphic material in a manner which may infringe copyright, trademark, service mark or other proprietary mark. A customer also may not use any logo or trademark in a vulgar, libelous, disparaging or otherwise unlawful manner. We assume no responsibility for damages or any wrong doing that the customer may cause using a logo, trademark or copyrighted items. You agree to indemnify and hold the blazingclothing.co.uk Parties harmless from and against any suit, demand, claim, loss, liability, damage or expense made against or incurred by blazingclothing.co.uk Parties by reason of the unauthorised, improper, or illegal use of any logo or trademark or copyright that is printed on or otherwise applied to promotional merchandise ordered or purchased by the customer through blazingclothing.co.uk.

Grant Of License To BlazingClothing.co.uk

When using our software to create any design, or when uploading or authorizing others to upload any copyrighted, trademarked or other protected material to blazingclothing.co.uk, you grant a license to blazingclothing.co.uk which gives blazingclothing.co.uk the non-exclusive, perpetual, irrevocable, paid-up, worldwide right and license to use, reproduce, modify, adapt, publish, translate and distribute such material (in whole or in part), modify and create derivative works from such material and/or to incorporate it in other works in any form, media or technology now known or hereafter developed for the full term of any copyright that may exist in such material. Subject to this grant of rights, you retain all rights you have in such material.

User Comments, Feedback And Other Submissions

All comments, feedback, suggestions, ideas and other submissions disclosed, submitted or offered to blazingclothing.co.uk or otherwise disclosed, submitted or offered in connection with your use of the Site shall be and remain blazingclothing.co.uk’s property. Such disclosure, submission or offer shall constitute an assignment to blazingclothing.co.uk of all worldwide rights, titles and interests in all copyrights and other intellectual property rights in such comments, feedback, suggestions, ideas and other submissions.

Accuracy Of Colours & Size

While we have made every effort to display as accurately as possible the colours, text and/or graphics of our products that appear on the Site, we cannot guarantee that your monitor's display of any colour, text size and/or graphic will be accurate. The colours and/or text sizes you see will depend on your monitor and may be different from the actual colours and/or text sizes of our product. We will have no liability (whether for damages, return of merchandise for credit, or otherwise) as a result of any variances between the appearance of colours, text sizes and/or graphics displayed on your monitor and on any finished product purchased by you. Please note the max print area size is 21cm X 15cm.

Glow in the dark & standard print on garments are NOT intended for safety applications & are sold as novelty items only.

Ancillary Computer Equipment And Services

You are responsible for and must provide all computer, telephone and other equipment and services necessary to access the Site. In addition, you are responsible for any access charges incurred through on-line services, telephone companies, or Internet service providers used in obtaining access to the Site.

Legal Compliance

You shall use blazingclothing.co.uk for lawful purposes only. You shall not transmit through blazingclothing.co.uk any material which violates or infringes in any way upon the rights of others, which is unlawful, threatening, abusive, defamatory, invasive of privacy or publicity rights, vulgar, obscene, profane or otherwise objectionable which encourages conduct that would constitute a criminal offense, give rise to civil liability or otherwise violate any law. We reserve the right, in our sole discretion, to refuse to produce goods and/or to terminate your access to blazingclothing.co.uk for any breach of this provision or any other provision of this Agreement.

Delivery

Delivery times are provided by the carrier, excluding weekends and bank holidays, and may vary with package destination, particularly during peak periods. Please note that delivery may take longer if circumstances beyond our control disrupt postal services.

Damaged/Lost Orders

If your order arrives damaged, you must contact Customer Services within 24 hours for further instructions. Please do not discard any of the merchandise or packaging materials, as we may need these items for further investigation.

If you have not received your order within 15 working days of despatch, you must immediately advise Customer Services of the delay/loss, within 2 working days.

Customs & Excise

All the necessary documentation that is needed to ship goods overseas will be completed by ourselves upon dispatch, though this is where our liability ends. Any import duty, laws and regulations are the sole responsibility of the customer.

Cancellation

We want to get your order out to you as quickly as possible, so we begin working on your order minutes after you submit your order. Once you authorise your transaction, we cannot guarantee our ability to make changes or cancellations to an order. If your order contains custom designs, it is not possible to cancel your order once it has been printed. If cancellations or changes are possible, we will do all we can to accommodate.

ALL refunds take up to 28 days to process and to be cleared funds on the original credit/debit card you used to make your purchase.

Returns

We do all we can to exchange or return items. First, you must request a return authorisation from our returns department. We do not accept any returns which have not received return authorisation. You must contact us within 7 days of receipt as we will not accept returns after 7 days. Next, you will need to ship your item back to us for a reship or credit less shipping. We will then email you information on how to return the goods to us. We do not have an exchange policy.

We do not accept returns on washed or worn shirts (see washing & care instructions) nor do we accept returns for custom, pre-designed or sale shirts.

We can not give refunds for designs made in the T-shirt creator or pre-designed t-shirts, unless we have made a mistake with your design or there is a problem with the print. Please make sure you have double checked your tee designs (such as spulling and grammar?) and you order the correct size before purchasing them as we will think these mistakes have been made on purpose.

We will have no liability (whether for damages, return of merchandise for credit, or otherwise) as a result of any variances between the appearance of colours, text sizes and/or graphics displayed on your monitor and on any finished product purchased by you. Please note the max print area size is 21cm X 15cm.

All products to be returned must be carefully repackaged in their original packing and the buyer to pay return postage.

Acceptance of Privacy Policy

If you use the Site, you are accepting the terms and conditions of our Privacy Policy. We will have the right to use your information as described in this Privacy Policy. If you do not agree to have your information used in any of the ways described in this Privacy Policy, you must discontinue use of the Site. Use of this site is when this privacy effective date begins. We reserve the right to modify this Privacy Policy at any time. Your continued use of the Site after we either personally notify you or generally post such changes on the site will constitute your acceptance of those changes.

Any brand names used on our website are the trademarks of their respective owners. The use of recognised brand names on the website is for the promotion of the sale of branded products and does not imply any affiliation or representation of the respective brand owners. SPECIFICALLY, WE DISCLAIM ANY AND ALL WARRANTIES, INCLUDING WITHOUT LIMITATION: 1) ANY WARRANTIES CONCERNING THE AVAILABILITY, ACCURACY OR CONTENT OF INFORMATION, PRODUCTS OR SERVICES; AND 2) ANY WARRANTIES OF TITLE OR WARRANTIES OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE.

THIS DISCLAIMER OF LIABILITY APPLIES TO ANY DAMAGES OR INJURY CAUSED BY ANY FAILURE OF PERFORMANCE, ERROR, OMISSION, INTERRUPTION, DELETION, DEFECT, DELAY IN OPERATION OR TRANSMISSION, COMPUTER VIRUS, COMMUNICATION LINE FAILURE, THEFT OR DESTRUCTION OR UNAUTHORIZED ACCESS TO, ALTERATION OF, OR USE OF RECORD, WHETHER FOR BREACH OF CONTRACT, TORTIOUS BEHAVIOR, NEGLIGENCE, OR UNDER ANY OTHER CAUSE OF ACTION. CUSTOMER SPECIFICALLY ACKNOWLEDGES THE SERVICE IS NOT LIABLE FOR THE DEFAMATORY, OFFENSIVE OR ILLEGAL CONDUCT OF OTHER CUSTOMERS OR THIRD-PARTIES AND THAT THE RISK OF INJURY FROM THE FOREGOING RESTS ENTIRELY WITH CUSTOMER.

NEITHER THE SERVICE NOR ANY OF ITS AGENTS, AFFILIATES OR CONTENT PROVIDERS SHALL BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL OR CONSEQUENTIAL DAMAGES ARISING OUT OF USE OF THE SERVICE OR INABILITY TO GAIN ACCESS TO OR USE THE SERVICE OR OUT OF ANY BREACH OF ANY WARRANTY.
